ஊழல் நீதிபதிகள் பட்டியல் வெளியானது-நீதித்துறை ஊழலுக்கெதிரான வழக்கறிஞர்கள் மாபெரும் பேரணி!
மதுரையில் கடந்த 10-09-2015 அன்று நீதித்துறை லஞ்சம் – ஊழல் ஒழிப்புப் பேரணி – ஆர்ப்பாட்டம் மதுரை உயர்நீதிமன்ற வழக்கறிஞர்களால் ஒருங்கிணைக்கப்பட்டு, தென்மாவட்ட வழக்கறிஞர்களால் நடத்தப்பட்டது. நிலைமையை எதிர் கொள்ள சென்னை உயர்நீதிமன்ற நீதிபதிகள் கூட்டம் பலமுறை நடத்தப்பட்டு வருகிறது.
பேரணி காலை சுமார் 11 மணிக்கு மதுரை மாவட்டநீதிமன்றத்தில் தொடங்கி உயர்நீதிமன்றத்தை அடைந்தது. பேரணி முடிவில் ஊழல் நீதிபதிகளின் முதல் பட்டியல் தென்மாவட்ட வழக்கறிஞர் சங்க நிர்வாகிகளால் வெளியிடப்பட்டது.
போராட்டத்தில் நாகர்கோயில், தூத்துக்குடி, இராமநாதபுரம், முதுகுளத்தூர், திருப்பத்தூர், காரைக்குடி, திருச்சி, குளித்தலை, கரூர், திண்டுக்கல், பழனி, தேனி, பெரியகுளம், திருமங்கலம், உசிலம்பட்டி, மேலூர், வாடிப்பட்டி, ராஜபாளையம், திருவில்லிபுத்தூர், கோவில்பட்டி, நெல்லை உள்ளிட்ட பல்வேறு இடங்களிலிருந்து சுமார் 1500 வழக்கறிஞர்கள் கலந்து கொண்டனர்.
பேரணி- ஆர்ப்பாட்டத்தில் பேசிய வழக்கறிஞர்கள் நீதிபதிகளின் லஞ்சம்-ஊழலை ஆதாரங்களோடு அப்பலப்படுத்திப் பேசினர். மேலும், உயர், உச்ச நீதிமன்ற நீதிபதிகளில் பெரும்பாலோனோர் ஊழலில் திளைத்து, ஒட்டு மொத்த நீதித்துறையும் அரசின் தொங்கு சதையாக மாறிவிட்டதை அம்பலப்படுத்தினர்.

கடந்த 15 நாட்களாக நீதித்துறை ஊழலுக்கெதிராக மதுரை வழக்கறிஞர்கள் வீதியில் இறங்கிப் போராடி வருகிறோம். நீதித்துறையின் ஒரு அங்கமான வழக்கறிஞர்களே, நீதிபதிகளின் ஊழலைப் பேசுவது ஒருவகையில் ‘பூசாரியே கடவுள் இல்லை’ என்று சொல்வதற்கு ஒப்பானது என்றாலும் “உண்மையைச் சொல்வது வழக்கறிஞர்களின் கடமை” என்ற அடிப்படையில் மக்கள் மன்றத்தில் நீதித்துறை தொடர்பான சில கேள்விகளை முன்வைக்கிறோம்.
- கடந்த 1947-லிருந்து 2015-வரை சுமார் 67 வருடங்களாக எந்த ஒரு ஊழல் நீதிபதியாவது விசாரிக்கப்பட்டு தண்டிக்கப்பட்டதுண்டா? இல்லை நீதிபதிகள் அனைவரும் உத்தமர்களா?

- கிரானைட் கொள்ளை வழக்கில் தலைமை நீதிபதி எஸ்.கே.கவுல் ”சகாயம் விசாரணைக்கு உத்தரவிட்டு வழக்கு நடந்து வரும்போது நீதிபதிகள் சி.டி.செல்வம், ராஜா, கர்ணன், தனபாலன்-வேலுமணி (Junior Judge) ஆகியோர் கிரானைட், தாதுமணல் கொள்ளையர்களுக்கு ஆதரவாகத் தீர்ப்பளித்தது ஏன்?

SPEAK UP AGAINST CORRUPTION IN INDIAN JUDICIARY
More than one thousand advocates across Tamil Nadu have jointly conducted Procession and Demonstration against Corruption in Indian Judiciary on 10-09-2015.
For the first time in the history of Indian Judiciary, All Tamil Nadu Advocates Associations have come together and conducted this historical procession and demonstration against the widespread corruption in our Judiciary particularly in the Madras High Court and subordinate courts in Tamil Nadu. Presently Indian Judiciary is in the throes of its worst ever morality crisis due to bribe received by Judges. Corruption has to be uprooted from the judiciary.
- The issue is intermittently debated in the last five years when former Kolkata High Court judge Soumitra Sen became the first judge in the country to be impeached by the Rajya Sabha for misappropriation of funds in 2011.
- P.D. Dinakaran, the former Chief Justice of the Sikkim High Court, had to resign in July 2011 following graft allegations.
- The next year, former Chief Justice of India K. G. Balakrishnan faced allegations that his family members had amassed wealth disproportionate to their known sources of income.
- In 2003, the CBI arrested Shamit Mukherjee, a former Delhi High Court judge, for his alleged involvement in a land scam.
A Judiciary which considers the rule of law a part of its basic structure must abandon the culture of corruption. Judiciary is one of the institutions of most corrupt practices hiding under the veil of secrecy and provision of contempt of court. For further positive reforms there is need of feedback and pointing out of problems but Provision of contempt of court and attitude of judiciary to avoid public scrutiny and being away from the transparency which restrict the criticism of errors, malpractices and loopholes in judiciary, which are truly against the spirit of democracy.
Justice Markandey Katju, retired judge of the Supreme Court made serious allegations against the Chief Justice of Supreme Court Mr.H.L.Dhattu and a judge of the Madras High Court.
Judiciary failed to look into People’s grievance and no action taken against Government Officials for violating Court order. But a division bench of Justice S Tamilvanan and Justice C T Selvam issued contempt of court notices to Madurai Bar Association president A Dharmarajan and secretary A K Ramasamy, asking them to explain as to why action should not be initiated against them under the Contempt of Courts Act. The bench issued the notice taking suo motu note of reports it had received from poilce officers and high court officials about incidents during advocates’ agitation and boycott of court proceedings in the aftermath of a high court order making helmet compulsory for two-wheeler riders. The Judges use the Suo Moto Contempt power for preventing Advocates to speak against the Order of Court among public. It is a judicial threat against the democracy system. Therefore all the Advocates Association will jointly fight against corruption and to save judiciary.
During the last two decades corruption has been growing in the Indian judiciary. A Former Chief Justice of India had to openly admit that 20% of the judges could be corrupt. In March 2010 a sitting Chief Justice of a Gujarat high court openly made a statement. The statement was published by the Times of India in its issue of 6th March 2010 with the headlines “In our judiciary, anybody can be bought, says Gujarat chief justice”. That India became a republic in 1950, when the people became sovereign. They got the right to constitute their institutions, the executive, the legislature and the judiciary, to serve them, who would be accountable to them. Before 1950, corruption was almost non existent in the High Courts. The Federal Court had in 1949 got Justice Shiv Prasad Sinha removed from the Allahabad High Court, merely on the finding that he had passed 2 judicial orders on extra judicial considerations. However appears that thereafter the judiciary has adopted the policy of sweeping all allegations of judicial corruption under the carpet in the belief that such allegations might tarnish the image of the judiciary. It does not realize that this policy has played a big role in increasing judicial corruption.
The Constitution of India prescribed removal by impeachment as the only way of removing judges who commit misconduct since it was believed at the time of the framing of the Constitution that misconduct by judges of the higher judiciary would be very rare. However those expectations have been belied as is apparent from the surfacing of a series of judicial scandals in the recent past. The case of Justice V. Ramaswami and subsequent attempts to impeach other judges has shown that this is an impractical and difficult process to deal with corrupt judges. The practical effect of this has been to instill a feeling of impunity among judges who feel that they cannot be touched even if they misconduct.
The corruption by judges is a cognizable offence. The Code of Criminal Procedure requires that First Information Report (FIR) has to be filed with respect to a cognizable offence and it is the statutory duty of the police to investigate the offence. The police have to collect evidence against the accused and charge-sheet him in a competent court. He would then be tried and punished by being sent to jail. The Supreme Court has however by violating this statutory provision in the CrPC given a direction in its Constitution bench judgment in the Veeraswamy case of 1991 that no FIR would be registered against any judge without the permission of the Chief Justice of India. In not a single case has any such permission ever been granted for the registration of an FIR against any judge after that judgment. So, the result of this direction has been that a total immunity has been given to corrupt judges against their prosecution. No wonder that judicial corruption has increased by leaps and bounds.
The honest judiciary enjoying public confidence is an imperative for the functioning of a democracy, and it is the duty of every right thinking person to strive to achieve this end. The level of corruption in judiciary is needed to be exposed in public domain for effective honest judicial system. It is the common perception that whenever such efforts are made by anyone, the judiciary tries to target them by the use of the power of contempt. It is the reputation of the judge which is his shield against any malicious and false allegations against him. He doesn’t need the power of contempt to protect his reputation and credibility.
Hence, we the advocates from Tamil Nadu strongly believes that a responsible citizen should be prepared to undergo any amount of suffering in the pursuit of the noble cause of fighting for a clean judiciary. Today we release the first list of CORRUPT JUDGES OF MADRAS HIGH COURT pertaining to the illegal mining cases. People must read the following judgments to know the corruption in judiciary.

Therefore we plead the Parliament to constitute a committee to enquire against the judges for impeachment proceedings and further we appeal to parliament to enact a separate law for enquire the corruptions of judges at earliest.
