தலித் மக்கள் உரிமைகளுக்காகவும், மனித உரிமைகளுக்காகவும் போராடும் இடது சாரி செயல்பாட்டாளர்களின் மீது அடக்குமுறையை ஏவும் விதமாக அவர்களது வீடுகளை சோதனை செய்வது மற்றும் அவர்களை ஆள்தூக்கி சட்டங்களின் கீழ் கைது செய்வது என அறிவிக்கப்படாத எமர்ஜென்சியை அமல்படுத்தத் தொடங்கிவிட்டது மோடி அரசு.
இதனை கண்டித்து சமூக வளைதளங்களில் பலரும் தங்களது கண்டனங்களை பதிவு செய்ய ஆரம்பித்துள்ளனர். இதன் விளைவாக டிவிட்டரில் #MeTooUrbanNaxal என்ற வார்த்தை டிரெண்டாகியுள்ளது. நாம் ட்ரெண்ட் செய்ய வேண்டியது வார்த்தைகளை மட்டுமல்ல செயலையும் தான்.

பீமா கோரேகான் போர் வெற்றியின் 200 ஆம் ஆண்டுவிழாவைக் கொண்டாடச் சென்ற தலித்துகள் மீது இந்துத்வ அமைப்பினர் நடத்திய கொடிய தாக்குதல் உலகளாவிய கண்டனத்தைப் பெற்றது. இந்தத் தாக்குதலுக்கு காரணமானவர்களை கைது செய்வதற்கு பதிலாக, அவர்கள் மீது நடவடிக்கை கோரி நடந்த போராட்டங்களை பயங்கரவாத நடவடிக்கையாக சித்தரித்து ஒடுக்குவதில் மும்முரம் காட்டி வருகிறது மகாராஷ்ட்ர காவல்துறை.

தலித்துகள், பழங்குடிகள், பெண்கள் மற்றும் சிறுபான்மையினர் நலனை காப்பதிலும், மத்திய அரசின் மக்கள்விரோதத் திட்டங்களை எதிர்ப்பதிலும், சங்பரிவாரத்தின் இந்துத்வ வெறுப்பரசியலை விமர்சிப்பதிலும் முன்னணியில் இயங்கும் கவுதம் நவ்லகா, சுதா பரத்வாஜ், வெர்னான் கன்சல்வெஸ், அருண் ஃபெரைரா, எழுத்தாளர் வரவரராவ் ஆகியோர் இன்று மகாராஷ்ட்ர காவல்துறையால் கைது செய்யப்பட்டுள்ளனர்.
அவர்களது மடிக்கணினி, செல்பேசி, பென் டிரைவ் ஆகியவையும் எடுத்துச் செல்லப்பட்டுள்ளன. அவர்களது சமூக ஊடகங்ளின் கணக்குகளும் காவல்துறை கட்டுப்பாட்டுக்குள் கொண்டு செல்லப்பட்டுள்ளன.
கல்வியாளரும் மனித உரிமைச் செயற்பாட்டாளரும் எழுத்தாளரும் அண்ணல் அம்பேத்கரது குடும்ப உறுப்பினருமான ஆனந்த் டெல்டும்டேவின் வீடும் சோதனைக்குள்ளாக்கப்பட்டுள்ளது.
நாடறிந்த ஆளுமைகளான இவர்களுக்கே இந்த கதியா..? என்கிற பீதிக்குள் கருத்தியல் தளத்தில் இயங்குகிறவர்களை மூழ்கடித்து, சுயதணிக்கையின் மூலம் அவர்கள் தம்மைத்தாமே முடக்கிக் கொள்ளும் நிலையை உருவாக்க ஆட்சியாளர்கள் முயற்சிக்கின்றனர்.

2010 எனறு நினைக்கிறேன், அமகாவின் பெண்கள் பிரிவில் இருக்கும் வெளி மாநிலத்தின் மனநலம் தேறிய நோயர்களை அவர்கள் வீட்டிற்கு கொண்டு போய் சேர்க்கும் பணியில் ஈடுபட்டிருந்தோம்.
அப்போது வார்டு எண் 14,15 -ல் இரு பெண்கள் சட்டிஸ்கர் மாநிலத்தின் குக்கிராமத்தை சேர்ந்தவர்கள்.அவர்கள் குக்கிராமத்திற்கு கொண்டு சேர்பது எப்படி என்று திட்டங்கள் முயற்சிகள் மேற்கொண்ட போது தான் நண்பர் ஒருவர் மூலம் மனித உரிமை செயற்பாட்டாளரும் வழக்குரைஞருமான தோழர் சுதா பரத்வாஜ் அவர்கள் எண் கிடைத்தது. அவரிடம் விஷயத்தை சொன்னோம். அனுப்பி வைக்க சொன்னார்.
சென்னை சென்ட்ரல் ரயில் நிலையத்திலிருந்து இரண்டு பெண் நோயர்களோடு மூன்று பெண் உடனாளர்கள், மூவருக்கும் இந்தி தெரியாது. அதிலொருவர் மாற்றுத்திறனாளி இருந்தாலும் நோயர்களை கொண்டு சேர்க்கும் கடமை உணர்ச்சியோடு அவர்கள் சென்றனர்.
ராய்பூர் ரயில் நிலையத்தில் அவரை மனித உரிமைகள் அமைப்பு சார்பாக இருந்த ஒருவர் அழைத்து சென்று இரவு தங்குவதற்கு இடமும் உணவும் கொடுத்து பாதுகாப்பாய் பார்த்துக்கொண்டார்.
மறுநாள் அவர்களை அழைத்துக்கொண்டு நோயர்களின் ஊர் தேடி பயணித்து கடினமான பாதைகள், உறவினர்களின் மனத் தடைகளை மீறி பெண் நோயர்களை அவர்கள் வீட்டில் சேர்க்க பேருதவி செய்தது தோழர் சுதா பரத்வாஜ் சார்ந்த மனித உரிமை அமைப்பு. அவர்களை வீட்டில் சேர்க்கும் வரை எல்லாவற்றையும் ஒருங்கிணைத்து செயல்படுத்தினார்.
அமகா பெண் உடனாளர்களை மீண்டும் பத்திரமாய் ரயில் ஏற்றி சென்னைக்கு அனுப்பி வைத்தார். சென்னை வந்த பெண் உடனாளர்கள் தங்கள் அனுபவங்களை பகிர்ந்து கொள்ள ஒரு நிகழ்ச்சி ஏற்பாடு செய்தோம். பாராட்டும் அவர்களின் சேவை ஊக்குவிக்க அது முக்கியமானதாக கருதினோம்.
எட்டுவருடங்கள் கடந்துவிட்டன அந்த பெண் நோயர்கள் இன்றும் சுதா பரத்வாஜ் அவர்களின் உதவியை மறக்கமாட்டார்கள். அவர் இல்லையென்றால் நாட்பட அமாகாவிலோ, அல்லது ஏதோ ஒரு என் ஜி ஓ ஹோமிலோ சிறையிலிருந்திருப்பார்கள்.
தங்கள் நிறுவனம் நலன், வளர்ச்சி , பொருளாதாரம் சார்ந்து மன நோயாளிகள் உரிமைகள் அதிகாரப் பகிர்வை அரிதாரம் பூசி சந்தையில் விற்பனை செய்யும் எத்தனையோ என்.ஜி.ஓ-க்கள் இருக்கின்றன. அவர்களுக்கு சர்வதேச, தேசிய விருதுகள்.

மனித உரிமை செயல்பாட்டாளர்கள் ஐந்து பேர் கைதுக்குத் தன்னாட்சித் தமிழகம் கடும் கண்டனம்.
மீண்டும் ஓர் அவசரநிலைக் காலம் பிறப்பிக்கப்பட்டுவிட்டதோ என்கிற அச்சம் இந்தியாவின் மூலை முடுக்கெல்லாம் நேற்று பரவியது. மனித உரிமைகளுக்காக போராடிய வரும் ஐந்து பேர் நேற்று கைதுசெய்யப்பட்டிருக்கிறார்கள்.
இந்தியாவின் ஏழு நகரங்களில், ஒரே சமயத்தில் திட்டமிட்டு மேற்கொள்ளப்பட்ட இந்த நடவடிக்கையில், புனே காவல்துறை, மும்பையில் வெர்ணோன் கான்சால்வஸையும் தானேயில் அருண் ஃபெரெய்ராவையும் தில்லியில் கெளதம் நவ்லேகாவையும் அரியாணாவில் சுதா பரத்வாஜையும் ஹைதராபாதில் புரட்சிக் கவிஞர் வரவர ராவையும் கைது செய்திருக்கிறது. கோவாலில் அம்பேத்கரிய அறிஞர் ஆனந்த் டெம்டுல்டேவும் மும்பையில் மனித உரிமையாளர் சூசன் ஆப்ரஹாமும் விசாரிக்கப்பட்டார்கள். இவர்களின் வீடுகளில் நேற்று காலை புகுந்த காவல்துறை, பின்பு இவர்களுக்கு மாவோயிஸ்ட் கட்சியோடு தொடர்பிருக்கிறது என்று கூறி முதலில் குறிப்பிடப்பட்ட ஐவரைக் கைதுசெய்திருக்கிறது.
இந்தக் கைதுகளையும் விசாரணைகளையும் தன்னாட்சித் தமிழகம் கடுமையாகக் கண்டிக்கிறது. இக் கைதுகளுக்கு எதிராக குழலெழுப்பியுள்ள அனைத்து எதிர்க்கட்சிகள், சமூக அமைப்புகள், அறிவுஜீவிகள் உள்பட அனைவரோடும் அது தன் கைகளை இணைத்துக்கொள்கிறது.
நரேந்திர மோடி தலைமையிலான மதவெறி-பாசிஸ்ட் அரசின் கோர முகம் உலகின் பார்வையில் கிழிந்து தொங்குகிறது. மகாராஷ்ட்டிரத்தில் பீமா கோரேகாவில் கடந்த எல்கார் பரிஷத் நிகழ்ச்சி தொடர்பாக இந்த கைதுகள் அரங்கேறியுள்ளன. இருநூறு ஆண்டுகளுக்கு முன்பு, 1818 ஜனவரி 1 இல் பீமா கோரேகாவில் நடந்த போர் ஒன்றில், பார்ப்பனீய பேஷ்வா ஆட்சியாளர்களுக்கு எதிராக மகாராஷ்ட்டிரத்தைச் சேர்ந்த தலித் மக்கள், ஆங்கிலேயர்களோடு இணைந்து போராடி, ஆதிக்கசாதி பேஷ்வா சாம்ராஜ்யத்தை உடைத்தெறிந்தார்கள். அந்த போரின் 200 ஆவது ஆண்டை நினைவுகூர்வதற்காக தலித் அமைப்புகளும் முற்போக்காளர்களும் 2017 ஆம் ஆண்டின் கடைசி நாளில் ஒரு நிகழ்வை ஏற்பாடு செய்திருந்தார்கள். குஜராத் தலித் தலைவர் ஜிக்னேஷ் மேவாணி உள்ளிட்ட பலரும் கலந்துகொண்ட அந்த நிகழ்வைத் தொடர்ந்து, புனே பகுதியில் ஆதிக்கசாதியினர் வன்முறையில் இறங்கினர். எல்கார் பரிஷத் நிகழ்வில் மாவோயிஸ்ட் தொடர்பு இருக்கிறது என்று காரணம் காட்டி மகாராஷ்ட்டிரா காவல்துறை இப்போது இந்த நடவடிக்கையை எடுத்திருக்கிறது.
இந்தியாவின் வரலாற்றை ஆதிக்க சாதியினரின் வரலாறாக மட்டுமே கற்பிக்க முயலும் ஆர் எஸ் எஸ்ஸின் நேரடி தலையீட்டில்தான் மகாராஷ்ட்டிர பாஜக அரசு இந்த நடவடிக்கைகளை மேற்கொண்டிருக்கிறது என்பது வெளிப்படையானது.
தலித் மக்களுக்கும் இடதுசாரி அரசியலுக்கும் இடையிலான உறவு என்பது எப்போதுமே அடிப்படையான அரசியல் உறவுதான். ஆனால் கைது செய்யப்பட்டவர்கள் பயங்கரவாதிகள் அல்ல. ஒடுக்கப்பட்ட மக்களின் உரிமைக்காக நிற்பது என்பது குற்றம் என்கிறது இந்திய அரசு. அதனால்தான் அவர்கள் மீது யுஏபிஏ உள்பட பல்வேறு சட்டங்களை ஏவியிருக்கிறது. அது மட்டுமல்லாமல் வெட்கங்கெட்டத் தனமாக, பிரதமர் மோடியைக் கொல்ல இவர்கள் சதித் திட்டம் தீட்டினார்கள் என்று குற்றம்சாட்டப்பட்டிருக்கிறது. தேசத்துக்கு அச்சுறுத்தல், பிரதமருக்கு அச்சுறுத்தல் என்கிற அதே பழைய தந்திரத்தைப் பயன்படுத்தி மனித உரிமையாளர்களையும் கவிஞர்களையும் தலித் தலைவர்களையும் மிரட்டிப்பார்க்கிறது மோடி அரசு.
கோரேகாவ் வன்முறை தொடர்பாக ஆதிக்கச் சாதியினரையும் அவர்கள் தரப்பில் ஈடுபட்டவர்களையும் சுதந்திரமாக விட்டுவிட்டு, பாதிக்கப்பட்டவர்களின் தரப்பில் இருப்பவர்களை அச்சுறுத்துவதன் மூலம் மோடி அரசு தான் யார் பக்கம் இருக்கிறது என்பதைக் காட்டிக்கொள்கிறதே தவிர வேறு ஒன்றும் இல்லை. இது மகாராஷ்ட்டிரத்தில் மராத்தா சமூக மக்கள், மற்றும் பிற ஆதிக்கசாதியினரிடம் அவர்களின் பாதுகாவலன் தாங்கள்தான் என்பதைக் காட்டிக்கொள்வதற்காக எதிர்வரும் தேர்தலை மனத்தில் வைத்து நகர்த்தப்படும் திட்டமும் ஆகும். மராத்திய இன மக்களை சாதி வேறுபாடுகளைக் கொண்டு பிளவுபடுத்தி அதில் பலனடையும் பிரித்தாளும் சூழ்ச்சிதான் இது. மராத்திய இன விவசாயிகளின் போராட்டங்களால் அதிர்ந்துபோயிருக்கும் மகாராஷ்ட்டிர பாஜக இப்போது மக்களை பிரித்தாள முயல்கிறது.
தோழர்கள் வர வர ராவ் உள்ளிட்ட அனைவருக்காகவும் நாம் குரல்கொடுக்கிறோம்.
ஏற்கனவே தமிழ்நாட்டில் தோழர்கள் திருமுருகன் காந்தி, வளர்மதி, முகிலன் உள்ளிட்டவர்கள் கைது செய்யப்பட்டிருக்கிறார்கள். மோடி அரசின் பாசிச நடவடிக்கைகள் தொடர்ச்சியாக நடந்துகொண்டே இருக்கின்றன. அதற்கு எதிராக தமிழ்நாட்டிலும் இந்தியாவின் பிற பகுதிகளிலும் உள்ள ஜனநாயக, முற்போக்கு சக்திகள் இணைந்து எதிர்கொள்வது காலத்தின் கட்டாயமாகும்.

இவரைப் போன்றவர்களை அம்பானி, அதானி, ராம்தேவ் மாதிரியான ஆட்கள் போட்டுத் தள்ளினால்தான் உண்டு, அதுவும் கொடுக்கல் வாங்கல் தகறாரில். மற்றபடி ஒரு பயலும் சீண்ட மாட்டான். தானாகவே அழியப்போறதுக்கு எதற்கு சதித் திட்டம் தீட்டுவார்கள்.?

On 28th August 2018, simultaneous raids were conducted by Police on the premises of prominent human rights and civil liberties activists and intellectuals – Advocate Sudha Bharadwaj (National Secretary, PUCL) in Faridabad, Father Stan Swamy in Jharkhand, Senior Writer and Poet Varavara Rao, his two daughters – Anala and Pavana, ‘The Hindu’ journalist KV Kumaranath, English and Foreign Languages University (EFLU) Professor Satyanarayana, ‘Namaste Telangana’ journalist Kranthi Tekula – all in Hyderabad, Anand Teltumbe (General Secretary, CPDR) in Goa, Gautam Navlakha (founder member, PUDR) in Delhi, Arun Ferreira, Writer Vernon Gonsalves and Advocate Susan Abraham in Mumbai, and several of them have been arrested on false and fabricated charges under the draconian UAPA law.
WE the aforesaid civil society organisations/ groups/ collectives, are jointly convening an urgent Press Conference to condemn the appalling state actions of reprisals against noted human rights activists and intellectuals, which are clearly politically motivated and an attempt to stifle voices of dissent. PUCL STRONGLY CONDEMNS AND DENOUNCES THE ARRESTS UNDER THE DRACONIAN UAPA OF
- Sudha Bharadwaj, PUCL National Secretary

- Vernon Gonsalves and Arun Ferreira, advocates, and
- Vara Vara Rao, noted poet and rights activist.

PUCL also denounces the simultaneous multi-city raids conducted today, 28th August 2018 in a concerted and pre-meditated manner across the country at the premises of other eminent human rights activists including:
- Father Stan Swamy in Jharkhand;
- Senior Writer and Poet Varavara Rao, as also the houses of his two daughters and sons-in-law, Anala and the Hindu journalist KV Kumaranath; and Pavana and her husband, Prof. Satyanarayana, of English and Foreign Languages University;
- Anand Teltumbde in Goa;
- Gautam Navlakha in Delhi,
- Arun Ferreira, Vernon Gonsalves and Susan Abraham, Advocates in Mumbai.
PUCL asserts that the arrests and raids are nothing but a targeted crackdown and attack by the police and state on civil liberties and democratic rights activists across the country in a concerted attempt to crush human rights interventions and silence voices of dissent;
Such systematic and pre-meditated crackdown on human rights activists is unprecedented and unheard of in a democracy and PUCL strongly condemns this unconstitutional crackdown by the state and police ;
PUCL stands firmly in solidarity with advocate Sudha Bharadwaj, National Secretary, PUCL and the other human rights activists who face raids and have been arrested under false and fabricated charges.
We would like to point out that in a Habeas Corpus petition filed before the Delhi High Court, his transfer on transit warrant to Pune has been stayed pending further hearing of the habeas corpus petition tomorrow 29th August, and he is currently under house arrest. As per sources, Anand Teltumbde’s house in Goa was raided by the police in a completely illegal manner, in his absence, after procuring keys from the security guard. While some news channels state that the raids and arrest have been made in the Pune case of Bhima Koregaon caste violence, where the prime accused are Hindutva right wing groups and leaders who are enjoying state impunity and at large, some other news agencies are alleging that the arrests are linked to claims of alleged plot to assassinate Prime Minister Narendra Modi and Chief Minister Devendra Fadnavis.
It is pertinent to note that just last month on 4th July 2018, a scurrilous, motivated, fabricated and malicious media propaganda and hate campaign was run by Republic TV and its anchor Ms. Shivani Gupta, Deputy Editor Mr. Shrawan Sen and its Managing Director, Mr. Arnab Goswami, by way of a series of programmes presented as “Super Exclusive Breaking News” and also showcased by way of a national debate on Prime Time TV. Relying on a fabricated letter allegedly addressed by her to a Maoist named ‘Comrade Prakash’, the channel repeatedly aired, completely false, unsubstantiated and scurrilous accusations against Advocate Sudha Bharadwaj, falsely profiling her as “Urban Naxal”. The allegations were categorically denied by Advocate Sudha Bharadwaj in her rebuttal statement. The programmes were aired with headers of“#UrbanNaxalsExposed” and similar allegations were made against other human rights activists like Mr. Gautam Navlakha in part 2 of the programme, via a second letter supposedly procured by the Channel. PUCL has previously issued a statement dated 7th July 2018 strongly condemning the incident and demanding strict action against the Channel. Advocate Sudha Bharadwaj also issued a legal notice in respect of the Channel’s illegal acts.
The current arrests and raids are taking place in the backdrop of the arrests of five human rights activists – Advocate Surendra Gadling, Professor Shoma Sen, Rona Wilson, Mahesh Raut and Sudhir Dhawale – who were also arrested under UAPA on 6th June 2018, relying on a similar fabricated letter produced by Republic TV allegedly addressed to the same “Comrade Prakash”, in the same Pune case. Following this, on 7th June 2018, Advocate Sudha Bharadwaj had addressed a press conference organized by the Indian Association of People’s Lawyers (IAPL) in New Delhi to condemn the arrest of Advocate Surendra Gadling of the Nagpur High Court. Susan Abraham, Arun Fererreia and Vernon Gonsalves are in fact representing the Bhima Koregaon accused in Court.
Advocate Sudha Bharadwaj has been a dedicated trade unionist for more than three decades and has served as a general secretary of its Chhattisgarh branch, during which time the branch did remarkable work in the State. She is also associated with the Chhattisgarh Mukti Morcha, which was founded by the late Shankar Guha Niyogi. She started her legal practice in the year 2000 and has since, fought innumerable cases of workers, farmers, adivasis and poor people in the fields of labour, land acquisition, forest rights and environmental rights. Since the year 2007, she has been practicing in the High Court of Chhattisgarh at Bilaspur and was nominated by the High Court to be a member of the Chhattisgarh State Legal Services Authority. She also supported young lawyers to set up the Jagdalpur Legal Aid group as a civil society initiative to provide legal aid to incarcerated Tribals. She is a visiting faculty at the National Law University Delhi, where she teaches the course on tribal rights and land acquisition.
PUCL believes that the intention of the state and police in targeting the aforesaid human rights activists by foisting false and fabricated cases against them, is clear and apparent from their profiles of work. All the aforesaid human rights activists targeted in this multi-city “operation” by the police have been tirelessly involved in advocating the cause and fighting for the rights of the most poor, marginalized sections of society against serious state violations and unscrupulous corporates. They have stood for the principles of human rights enshrined in the Indian Constitution and the international standards on human rights.
PUCL strongly condemns the actions of the state and police. This simultaneous crackdown against human rights activists across the country signals the imposition of an unofficial Emergency in our nation and is a direct attack on Indian democracy. This is a deliberate strategy of the state to target noted human rights activists in a clear act of reprisals against them for calling out the human rights violations by the state and police, and to intimidate those who are fighting for justice.
PUCL cautions the public at large on the concerted efforts underway to stifle voices of dissent and threaten the democratic fabric of the country.
In light of the above, PUCL makes the following urgent demands:
- PUCL calls upon the state and the police to immediately and unconditionally release human rights activists, Sudha Bharadwaj, Gautam Navalakha, Anand Teltumbde, Varavara Rao, Arun Ferreira, Kranti Tekula and Vernon Gonsalves and withdraw the false and fabricated case against them;
- PUCL calls upon the National Human Rights Commission (NHRC) to urgently intervene to ensure the release of the human rights activists and to order an immediate, transparent, effective and impartial investigation into the simultaneous multi-city raids and arrests of the human rights activists by the state and the police on false and fabricated accusations and charges ;
- PUCL also calls upon the democratic minded citizens of India to condemn the unprincipled manner in which human rights activists are being targeted and oppose such insidious and collusive attempts by State agencies and media outfits to silence human rights activists against the vindictive State policies and action ;
- PUCL further condemns the constant profiling as “Urban Naxals/ Maoists” and criminalisation of human rights activists working tirelessly against the state’s anti-people actions and policies, in an attempt to malign them and influence public sentiment.
